These terms apply to the purchase, renewal and management of the domain names offered by Cowa Services SARL-U, publisher of MonEtalo. They complete our Terms of Service and our Privacy Policy. Where they differ on a point specific to domain names, these terms prevail. By confirming a domain name order, you accept them.
1. Who does what#
1.1 MonEtalo, reseller#
MonEtalo sells domain names as a reseller. We are neither the registry of an extension (the body that runs, for example, .com) nor an accredited registrar. We place your orders with a partner registrar accredited by ICANN, which passes them on to the extension’s registry.
1.2 ICANN and registry rules#
Every domain name is subject to the rules of ICANN (the worldwide domain name body) and of the registry of its extension. These rules bind you as they bind us: they may require checks, set deadlines or provide dispute procedures. The registrant rights and responsibilities defined by ICANN are available at icann.org.
2. Ordering#
2.1 Availability#
A name is available only if nobody else has registered it. The availability shown during your search is checked again before payment, then at registration: a name may be taken in the meantime. Some so-called “premium” names, sold at a higher price by their registry, are not offered.
2.2 Forbidden names#
You may not register a name that imitates a brand, a bank, a telecom operator, a public authority or a person without being entitled to it, nor a name meant to mislead. In that case we may refuse an order or suspend a domain.
2.3 Term#
A domain name is registered for one year, renewable year after year.
3. Prices and payment#
3.1 One price, the same every year#
The price shown is the price of one year, all taxes included. It is also the renewal price, as long as it has not changed under section 3.3.
3.2 Payment#
Payment is made online, with Mobile Money or a card, on the secure page of a payment aggregator. An order is paid only once the aggregator confirms the payment to us. An invoice is issued for every purchase and every renewal; you find it in “My domains”.
3.3 Price changes#
Our prices depend in particular on registry rates and exchange rates. If they change, the new price applies to the following renewals. We let you know at least 30 days before your renewal date.
3.4 First year free#
With a Pro or Business plan paid yearly, the first year of a domain name in an extension marked as free (for example .com) costs nothing, once per yearly payment. The following renewal is at the normal price, shown when you order. If the name cannot be registered, the benefit remains available for another name.
4. Registration and owner#
4.1 The domain is yours#
The domain name is registered in the name of the owner given in the order: you, or the business you represent. You are responsible for the accuracy of this information and for keeping it up to date.
4.2 Owner email confirmation#
After registration, a confirmation email is sent to the owner’s address. You must click the link it contains within 15 days. Without confirmation, the registrar suspends the domain until it is done. You can ask for this email again from “My domains”.
4.3 Accurate information#
False or incomplete information may lead the registry to suspend or delete the domain, without refund.
4.4 Hidden data#
Where the extension allows it, your details are hidden in the public domain name directory (WHOIS). They remain known to the registrar and the registry, and may be disclosed to authorities where the law or ICANN rules provide for it.
5. Renewal and expiry#
5.1 No automatic renewal#
Nothing is renewed without your payment. We remind you by email 30, 15, 7 and 1 day before the renewal date. Renewing in time is your responsibility.
5.2 After the renewal date#
A domain that is not renewed stops working on its renewal date. For a period that depends on the extension, it can still be renewed at its normal price. After that, getting it back may involve restore fees set by the registry; then the domain is released and someone else can register it.
6. Transfer and security#
6.1 Lock#
Your domain is locked against unauthorised transfers. Turning the lock off from “My domains” requires your password; you are notified by email.
6.2 Moving to another provider#
You may transfer your domain to another provider at any time. Your transfer code is sent to you through a single-use link valid for 30 minutes. ICANN rules forbid transfers for 60 days after a registration or a transfer, and may forbid them after an owner change.
7. Using the domain#
You use your domain in accordance with the law, the rights of others and our Acceptable Use Policy. Phishing, fraud, malware, spam or unlawful content may lead to the immediate suspension of the domain, by us or by the registry.
8. Domain name disputes#
If a third party believes your domain name infringes their rights, they may start a procedure provided by ICANN or registry rules, such as the UDRP. You agree that these procedures apply and that their decision may lead to the transfer or deletion of the domain.
9. No withdrawal, no refund#
A domain name is registered immediately after your payment and cannot be undone. You therefore waive your right of withdrawal once the registration is done, to the extent permitted by law. No refund is due once the domain is registered or renewed. If a paid registration or renewal cannot be carried out, you are refunded in full.
10. Liability#
We do our best to process your orders and renewals quickly and without error. We are not liable for the decisions or outages of registries and the registrar, nor for the consequences of a domain not renewed in time, inaccurate information or an unconfirmed email. The liability limits of our Terms of Service apply.
11. End of service#
If your MonEtalo account is closed, your domains remain yours until their renewal date: we give you their transfer code so you can move them to another provider.
12. Governing law#
These terms are subject to the same law and dispute resolution rules as our Terms of Service, subject to the domain name procedures described in section 8.
